NC doesn’t require that you file anything. You don’t have to be separated for any particular period of time to be legally separated. If you start dating before you are separated it is called adultery. Adultery can have a devastating impact on alimony.
If infidelity/adultery — an intimate relationship with someone other than your spouse prior to separating — is an issue, then continuing a relationship with that same person after the separation can be used as evidence to prove adultery. Proof of adultery may affect alimony and child custody.
Can you be in a relationship while legally separated in NC?
