Who can ask about disability?

If you are applying for a job, an employer cannot ask you if you are disabled or ask about the nature or severity of your disability. An employer can ask if you can perform the duties of the job with or without reasonable accommodation.

Can you ask questions about an obvious disability?

The ADA places restrictions on employers when it comes to asking job applicants to answer medical questions, take a medical exam, or identify a disability. An employer may not ask a job applicant, for example, if he or she has a disability (or about the nature of an obvious disability).

When can an employer ask questions regarding an individual’s disability?

Under the law, employers generally cannot ask disability-related questions or require medical examinations until after an applicant has been given a conditional job offer.

How do you prove you have a disability?

There are two ways to show disability: First: You can prove disability for EAEDC without a medical review if: You received a letter from the Social Security Administration (SSA) approving you for Supplemental Security Income (SSI) or Social Security (SSDI) but you do not have those benefits yet; or.

Can you legally ask someone if they are disabled?

You could ask the person if they need assistance due to them standing in the handicap line, because it is not illegal to ask them if they need special assistance.

Should I declare disability on application?

Generally, there is no obligation to disclose disability-related information to an employer until the need for reasonable accommodation becomes apparent. Reasonable accommodation may be needed to participate in the hiring process, to perform essential job functions, or to receive a benefit or privilege of employment.

How do I disclose my disability?

You can use “plain English” to make your request and you do not have to mention the ADA or use the phrase “reasonable accommodation.” Once you disclose, then the interactive process should begin. At this point, your employer can ask for limited information about your disability and your need for accommodations.
