When can I claim my wife as a dependent?

You do not claim a spouse as a dependent. When you are married and living together, you can only file a tax return as either Married Filing Jointly or Married Filing Separately. You would want to file as MFJ even if one spouse has little or no income.

How long can you claim someone as a dependent?

You can claim dependent children until they turn 19, unless they go to college, in which case they can be claimed until they turn 24. If your child is 24 years or older, they can still be claimed as a “qualifying relative” if they meet the qualifying relative test or they are permanently and totally disabled.

The IRS doesn’t allow a married individual to claim their spouse as a dependent, even if one spouse has no income or if the spouses live apart from each other. As a reminder, the IRS considers you married for tax purposes if you were legally married on or before December 31.

Can a married couple claim a spouse as a dependent?

Claiming Two: If only one spouse works, the working spouse can claim two and will probably come close to breaking even when filing taxes. For each additional child or dependent, just add one to the number of allowances based on the the example above.

Can a qualifying child be claimed as a dependent?

The General Rule. In tax terms, a ” dependent ” meets the criteria of being either a qualifying child or a qualifying relative of the taxpayer, who is then entitled to claim that person’s personal exemption on his tax return to reduce his taxable income.

Can a nonresident alien claim another spouse as a dependent?

It must be their intention to remain living apart from you indefinitely. You additionally have paid for more than half your residence’s expenses and you must have had another dependent. A similar set of rules applies if your spouse is a nonresident alien.
